TERMS AND CONDITIONS OF EVERYDAY GRACE GUIDES  

1. Terms and conditions for the supply of products.

1. You must be 18 years old or over to place orders on this site.
2. By accessing this site or by placing an order you are agreeing to be bound by all the terms and conditions of Everyday Grace Guides.

2. Definitions
References to “you” mean you the viewer, user, buyer or customer.
The words “We” “Us” “I” “Our” and “EverydayGraceGuides.co.uk” refer to “Everyday Grace Guides”.

3. Formation and completion of contract

1. 1. By making a payment, you are placing an order and offering to buy a digital product. 
   2. The offer to buy a digital product is not the formation of a contract.
   3. Once payment has actually been received by us, you will be emailed an Order Acknowledgment/Payment Receipt.
   4. The payment receipt will indicate acceptance of the offer to buy. It will also indicate the formation of a contact to supply a digital product. 
   5. The digital product(s) will be made available for download after payment has been received.
   6. When the digital product(s) have been made available for download, then the contract will be complete.

4. Electronic communications and use of emails

1. Everyday Grace Guides communicates with customers electronically by displaying information on this website. When you place an order through this site you are communicating electronically and you agree that electronic communications between us satisfies any legal requirements that such communications be in written medium.
2. When you place an order you must register an account.  When you register you must submit your name, an email address, a phone number and address. Your information is confidential and will not be passed on to third parties by Everyday Grace Guides. Your information will be used by Everyday Grace Guides to process your orders. When you log into your account you will be able to view orders that you have placed and edit your details on your profile page.
3. By submitting your email address and creating an account, you give implied permission to receive email updates about the latest news, additions and offerings from Everyday Grace Guides. You can unsubscribe from this service at any time.

5. Payment
Payment must be made by Debit or Credit card online when placing orders and made in U.K. Pound Sterling. We reserve the right not to process an order unless the correct amount of money is received and funds have cleared the account of Everyday Grace Guides.

6. Cancellations, Returns and Refunds
Due to their nature:
Digital products cannot be cancelled.
Digital products cannot be returned.
There are no refunds for digital products.
All sales are final.

7.    Prices

1. All item prices are quoted without VAT. We do not currently charge VAT. 
2. Prices are subject to change without prior notice and will apply from date of publishing. Prices for orders already received and accepted by Everyday Grace Guides will stand.
   

 8.    Copyright and intellectual property

1. Artwork and designs for our products have been created by Everyday Grace Guides; are owned by Everyday Grace Guides and are protected by copyright law.
2. Our digital products are for your personal use only.
3. You may not copy or create derivative works of the designs for commercial use in any form (i.e. no digital products, no physical products, no website designs, or any other purpose). Reproduction of any of the designs in any form without prior express written permission from Everyday Grace Guides is strictly prohibited. Breach of this prohibition will violate copyright laws and may render the offender(s) liable to civil proceedings and criminal penalties.

9.   Waiver
Any goodwill gesture by Everyday Grace Guides to waive any part of it’s rights under this agreement, shall not constitute a waiver of the rest of Everyday Grace Guides’s rights.

10.  Limitation of liability

Should Everyday Grace Guides be found to be in breach of this agreement, the remedies of the customer shall be limited to, damages which shall not exceed, the amount of value on the receipt, of the digital product giving rise to the claim.

Everyday Grace Guides shall not be liable for any consequential or indirect losses, however such loss or damage may be incurred.

11.  Change of terms

1. The terms contained herein may be amended at any time without notice by Everyday Grace Guides and will apply from date of publishing.
2. No variations, modifications or substitutions of these terms and conditions shall be binding on Everyday Grace Guides.

12.  Construction or performance of this agreement

Examples of causes beyond our reasonable control are as follows:

• • • Act of God; fire; flood; tempest.
    • Explosion; accidents.

2. The construction, validity and performance of this agreement shall be governed by UK English Law / The Laws of England.
3. Severability: If any provision in these terms and conditions, (whether in whole or in part), is held to be invalid or unenforceable by any relevant competent authority within the UK, then the other provisions of these terms and conditions shall not be affected thereby. 

13.   Unsettled disputes, claims or proceedings
Any unsettled disputes, claims or proceedings of whatever nature, arising from the validity, construction or performance of this agreement, shall be governed by English Law and subject to the exclusive jurisdiction of The High Court Of England and Wales, to which both parties irrevocably submit.

14.  Affiliate and Advertising disclosure
This website may have advertising and affiliate links which enable you to purchase products and services provided by different merchants/suppliers. These advertising and affiliate links act as a source of income for us. Clicking on these links will not cost you any extra money.
